Agreement on Voluntary Charitable Donation

This Public Offer (hereinafter referred to as the “Offer”) constitutes an official proposal by the Non-Governmental Institution “Charitable Family Children’s Home ‘Nur'”, registered under BIN 981240015961 (hereinafter referred to as the “Recipient”), to conclude an Agreement on Voluntary Charitable Donation (hereinafter referred to as the “Agreement”) with any individual and/or legal entity (hereinafter referred to as the “Donor”) on the terms set forth below.

1. GENERAL PROVISIONS

1.1. This Offer constitutes a public offer in accordance with Article 395 of the Civil Code of the Republic of Kazakhstan (CC RK).
1.2. Acceptance of this Offer by the Donor shall be deemed as the action of transferring funds to the Recipient’s settlement account via the payment instruments provided on the website nur.org.kz (including Kaspi remote payment, QR code payment, link payment, or bank transfer).
1.3. The Donor’s action of transferring funds signifies full and unconditional agreement with all terms of this Offer (acceptance of the offer pursuant to Article 396 of the CC RK).
1.4. The Agreement between the Recipient and the Donor shall be deemed concluded at the moment the funds are successfully debited from the Donor’s account or card in favor of the Recipient.

2. SUBJECT OF THE AGREEMENT

2.1. The Donor gratuitously transfers to the Recipient, as a voluntary charitable donation, their own funds (hereinafter referred to as the “Donation”) in an amount determined solely by the Donor.
2.2. The purpose of the Donation is: the maintenance of the residents, support of their statutory activities, improvement of living conditions, payment for medical treatment, education, utility services, purchase of food and clothing, as well as the implementation of social and charitable programs of the “Nur” children’s home.
2.3. In accordance with Article 506 of the CC RK, this transfer is recognized as a donation and is of a non-commercial, gratuitous nature. The Donor does not pursue the goal of making a profit or receiving any services/goods in return.

3. RIGHTS AND OBLIGATIONS OF THE PARTIES

3.1. The Recipient undertakes to:

  • Use the received funds exclusively in accordance with the purposes specified in Clause 2.2 of this Offer and the Charter of the organization.
  • Publish reports on the use of the received charitable donations on the official website nur.org.kz in accordance with the requirements of the legislation of the Republic of Kazakhstan for NGOs.

3.2. The Recipient has the right to:

  • Independently distribute the received funds among the statutory needs of the children’s home, unless the Donor specified another specific purpose when sending the payment.

3.3. The Donor has the right to:

  • Independently determine the amount and frequency of the voluntary donation.
  • Review reports on the targeted use of funds on the Recipient’s website.

4. PROCEDURE FOR MAKING DONATIONS

4.1. Donations are made by the Donor electronically via integration with Kaspi Pay or other payment gateways presented on the website nur.org.kz.
4.2. The Donor independently specifies the payment amount and confirms the transaction in their banking application.
4.3. All expenses related to the transfer of funds (bank commissions, if applicable) are governed by the tariffs of the servicing bank (JSC “Kaspi Bank”).

5. REFUND OF FUNDS AND CONFIDENTIALITY

5.1. The Donation transferred to the Recipient is recognized as an irrevocable gift (pursuant to the norms of the CC RK) and is not subject to refund to the Donor, except in cases where the Recipient has used the funds contrary to the statutory purposes of the organization.
5.2. The Recipient undertakes not to disclose the Donor’s personal data (full name, contact details, amounts), except as provided by the Law of the Republic of Kazakhstan “On Personal Data and Their Protection” and the website’s Privacy Policy.

6. TERM OF THE OFFER

6.1. This Offer enters into force from the moment it is posted on the Recipient’s website and remains in effect indefinitely until it is amended or withdrawn by the Recipient.
6.2. The Recipient reserves the right to make changes to this Offer without prior notice. Amendments shall enter into force on the day following their publication on the website nur.org.kz.
